Conditions for including an employer in Qualified Worker Program

Active companies:

• Engaged in production or provision of services or operating in the public sector
• Engaged in agricultural production or in forestry and wood processing industries or the company is a food producer or a registered producer of finished feed
• For food-producing animals
• With at least 6 employees for a period of three months
• With balanced liabilities to the state:
  1. It has no tax arrears on business
  2. It has no arrears on social security premiums and contributions to the state employment policy
  3. It has no arrears on public health insurance premiums
• In the period of 2 years prior to the submission of the application for inclusion in the Program, the following was not imposed on the employer (an active company fulfilling the above):
  1. A fine higher than CZK 100,000 for enabling the performance of illegal work
  2. Repeatedly a fine higher than CZK 100,000 for breach of obligations arising from legal regulations inspected by the Labor Office of the Czech Republic, the State Labor Inspection Authority or regional labor inspectorates or the obligation to collect public health insurance premiums.
  3. Penalty for ilegal employment.
• The employer has published a vacancy in the central register of vacancies available to the holder of the employee card and selected a specific employee for this position - a third-country national with whom he intends to enter into or has already entered into an employment relationship.

Conditions for including an employer in Highly Qualified Worker Program

A company which is at least 2 years active:

• Engaged in the production or provision of services or operating in the public sector
• Providing health services
• A tax resident of the Czech Republic
• It is registered in the Czech Republic as a payer of health and social insurance
• It employed or has employed at least 3 people in the period of 2 years before submitting the application
• With balanced liabilities to the state:
  1. It has no tax arrears on business
  2. It has no arrears on social security premiums and contributions to the state employment policy
  3. It has no arrears on public health insurance premiums
• In the period of 2 years prior to the submission of the application for inclusion in the Program, the following was not imposed on the employer:
  1. A fine higher than CZK 100,000 for enabling the performance of illegal work
  2. Repeatedly a fine higher than CZK 100,000 for breach of obligations arising from legal regulations inspected by the Labor Office of the Czech Republic, the State Labor Inspection Authority or regional labor inspectorates or the obligation to collect public health insurance premiums.

Conditions for including an employer in Key and Research Staff Program

The employer published a vacancy in the central register of vacancies available to the holder of the employment card and selected a specific employee for this position - a citizen of a third country with whom he intends to enter into or has already entered into an employment relationship.

General criteria:

1. The employer is a tax resident of the Czech Republic pursuant to Act No. 586/92 Coll., On Income Taxes.
2. The employer is registered in the Czech Republic as a payer of health and social insurance.
3. The employer (with the exception of a newly established company and a start-up company) carries out activities in the field of research, development, innovation, production, provision of services or it operates in the public sector.
4. The employer has balanced liabilities to the state: a) It has no tax arrears on business b) It has no arrears on social security premiums and contributions to the state employment policy, c) It has no arrears on public health insurance premiums;
5. In the period of 2 years prior to the submission of the application for inclusion in the Program, the employer was not imposed:
   1. A fine higher than CZK 100,000 for enabling the performance of illegal work or,
   2. Repeatedly a fine higher than CZK 100,000 for breach of obligations from legal regulations inspected by the Labor Office of the Czech Republic, the State Labor Inspection Authority or regional labor inspectorates or the obligation to collect public health insurance premiums.
   3. Penalty for ilegal employment.

The employer has published a vacancy in the central register of vacancies available to holders of an employee card or blue card and has chosen a specific employee for this position - a third-country national with whom it intends to enter into or has already entered into an employment relationship. In the case of employment of a foreigner with free access to the labor market pursuant to Section 98 of Act No. 435/2004 Coll., On Employment, the fulfillment of this condition is not required. It is also not required for Program participants who do not enter into an employment relationship in the Czech Republic. These criteria also apply mutatis mutandis to an employer already included in the Program who is applying for the inclusion of another foreign worker. 6 4.1.2 Specific criteria according to the type of employer The investor has been operating in the Czech Republic for at least 1 year and employs at least 50 people in the Czech Republic and 250 people worldwide as of the date of application. Research organization The organization is registered in the List of Research Organizations. Technology company Concludes a cooperation agreement in the field of science and research with a research organization registered in the List of Research Organizations Newly established company. • It undertakes to employ at least 20 employees within two years of its entry in the Commercial Register; in the case of a company operating in the field of "IT / SW development" at least 10 employees. • It will apply for an investment incentive or document a contract for the provision of business premises. Start-up • It concludes an incubation contract with an incubator listed in Appendix 1, or • It is capital-linked to a technology investor included in the list in Appendix 1. The decision to include an employer in the Program is valid for 1 year. However, this does not affect the possibility that the Program may be suspended or terminated even before the expiry of this period. An employer may apply for inclusion repeatedly.
